How To File TDS On Property In 2024?
When working in real estate, you may come across a lot of lingo. Tax Deducted at Source (TDS) on property sales is one example of this. The Income Tax Act of 1961's section 194-IA lists only immovable property, such as buildings and plots, as the property for which TDS is due.

When a buyer pays a seller more than Rs 50 lakh for real estate, the buyer must first deduct this tax from their payment. One percent of the entire transaction price is the buyer's TDS.

How to file TDS on property in 2024?
- Enter your cell phone number, validate your PAN, and then proceed.
- Select "New Payment" by clicking.
- Choose Proceed in accordance with 26 QB (TDS on Property Sale).
- Complete the form with information like
- Seller's residential status; Buyer's and Seller's PAN card data
- The buyer's and seller's email addresses
- Details about the property
- Payment/credit amount and tax information
- Next, select your preferred payment method from the list below, then click Proceed to complete the transaction.
- Online banking
- Debit card
- Bank
- NEFT/RTGS Payment Gateway
- Following payment, you will receive an acknowledgment in the form of a challan with your CIN, payment information, and bank account details.
- After five days, use the TRACES portal at www.tdscpc.gov.in to get the downloaded file.

How To Download Form 16B?
- Use your PAN to log in to the TRACES site.
- Click on the Downloads section and choose Form 16B for buyer.
- Provide the property facts that require Form 16B. Click "Proceed" after entering the seller's PAN, acknowledgment number, and assessment year.
- On the confirmation box that appears, click Submit Request to continue.
As soon as the download request is sent, a success notification will show up and the desired files will be downloaded. With the request number, you may look up the request. Click the HTTP download button after selecting the request row.

What Are The Changes In TDS Rules For Immovable Properties?
A few provisions pertaining to TDS in the case of immovable assets have been modified by the government. As a result, when determining the tax due at the time of making the property payment, more fees will soon be added to the cost of the property. These will cover any fees for maintenance, club membership, energy, water facilities, parking, and other advances.

For example, if a property is purchased for Rs 60 lakh, the buyer must deduct TDS at the rate of one percent on Rs 60 lakh rather than on the amount that exceeds the Rs 50 lakh threshold limit.
Further, if payments are being paid in instalments, such as in case of purchase of an under-construction home, the deductions should be made at the time of each payment. For a non-resident Indian (NRI) vendor, the regulations could change.

TDS On Property Purchase From NRI Seller
In the event that you purchase a property from an NRI, you will be responsible for deducting 20% TDS in addition to 4% cess. When an NRI seller sells their property within two years of buying it, they must deduct 30% TDS in addition to 4% cess.

Points To Remember When Deducting TDS For Property Payment
- If the selling value is less than Rs 50 lakh, no TDS is due.
- To deduct TDS, buyers do not require a Tax Deduction Account Number (TAN).
- TDS will be withheld at the rate of twenty percent if the vendor does not have a Permanent Account Number (PAN).
